Terms of Service

These are the rules for using Gamify. The parts most worth reading before you sign up: what an administrator of a team workspace can see about you, what counts as manufacturing activity to inflate a score, and the fact that points are a motivational signal rather than an authoritative record of anything.
1.Agreement to these terms
These terms are a contract between you and [LEGAL ENTITY NAME] ([REGISTERED POSTAL ADDRESS]), which operates Gamify. By creating an account or using the service you agree to them. If you do not agree, do not use the service.
If you are agreeing on behalf of an organisation — which is what creating or administering a team workspace means — you confirm you have the authority to bind that organisation, and "you" in these terms means the organisation.
2.What the service does
Gamify connects to third-party services you already use, reads your recent activity from them, and applies scoring rules to turn that activity into points, levels, streaks, and badges. Depending on your workspace, it may also rank members on a leaderboard, expose a read-only API, and provide an embeddable leaderboard widget.
The service reads from connected tools; it never writes to them. Points, levels, and badges are a representation of activity for motivation and visibility. They are not a performance-management system, they are not a record of employment, and they are not guaranteed to be complete or accurate.
3.Your account
- You must be at least 16 years old to create an account.
- You must give an accurate email address and confirm it before the account becomes usable.
- You are responsible for keeping your password secure and for everything done through your account.
- One person, one account. Do not share an account or let anyone else use yours.
- Tell us promptly if you believe your account has been compromised.
4.Workspaces and administrators
Every account belongs to exactly one workspace. An individual workspace has a single member: you. A team workspace has an administrator who controls it.
If you join a team workspace — by invitation or because your organisation set one up — understand what the administrator can do. They can see your activity history, your point transactions, and which services you have connected. They can set and change the rules that decide what your activity is worth, adjust your points manually, remove you from the workspace, and delete your account within it. They can also publish the workspace leaderboard outside the workspace using an embed key.
We act on an administrator's instructions for their workspace. Disputes between you and your workspace administrator are between you and them.
5.Paid plans
Individual workspaces are currently free. Team workspaces are a paid feature and are set up by arrangement — write to gamifysaas@gmail.com and we will agree the terms, price, and billing period with you directly in writing.
Where a paid arrangement is in place, fees are payable as agreed and are exclusive of any tax, which you are responsible for. Fees already paid are non-refundable except where the law requires otherwise. We may change pricing for a future billing period with at least 30 days' notice; a change never applies to a period you have already paid for.
While the free tier exists we may change what it includes, but we will not reduce it without telling account holders first.
6.Connected services
When you connect a third-party service, you authorize us to access it on your behalf with the permissions shown on that service's own consent screen. You confirm you are entitled to grant that access — in particular, that connecting a work account does not breach your employer's or that service's own rules.
Those services are operated by other companies under their own terms. We do not control them. If one changes its API, restricts access, rate-limits us, or goes offline, activity from it may be delayed, incomplete, or stop arriving entirely. That is not a breach of these terms and is not grounds for a refund.
You can disconnect any service at any time from the Connections page.
7.Acceptable use
You agree not to:
- Manufacture activity to inflate your score. Generating events that do not reflect real work or real effort — empty commits, throwaway tickets, scripted messages — in order to earn points, climb a leaderboard, or extend a streak. This is the one rule that matters most, because the whole product depends on the numbers meaning something.
- Attempt to access another user's or another workspace's data, or probe, scan, or test the security of the service without our written permission.
- Reverse engineer, decompile, or attempt to extract source code from the service, except where that restriction is unenforceable by law.
- Use the service to store or transmit anything unlawful, or to harass, bully, or single out any person.
- Scrape the service, or use the API or embed beyond the limits we set, in a way that degrades it for anyone else.
- Resell, sublicense, or provide the service to a third party as your own product without our written agreement.
- Use automated means to create accounts, or create an account on behalf of someone else without their knowledge.
Administrators should note that they are responsible for the scoring rules they configure and for how the resulting numbers are used within their organisation.
8.API keys and embed keys
An administrator can create two kinds of key, and they are not equally sensitive.
A secret key grants read access to your workspace's data through the API. Treat it like a password: keep it server-side, never put it in browser code or a public repository, and revoke it immediately if it leaks.
An embed key is designed to be visible in the source of whatever page hosts the leaderboard. It grants nothing but that leaderboard view. Publishing one is expected; publishing a secret key is not.
You are responsible for activity carried out with your keys. We may revoke a key that is being used abusively.
9.Your data
You keep ownership of your data. You grant us the licence we need to host, process, and display it for the sole purpose of providing the service to you — nothing broader, and it ends when the data is deleted.
How we handle personal data is set out in our Privacy Policy, which forms part of these terms.
10.Availability and changes
We aim to keep Gamify available and working, but we do not offer a service level agreement. The service may be unavailable for maintenance, for reasons at our infrastructure providers, or because a connected service is having problems.
We may add, change, or remove features. If we remove something you depend on, or make a change that materially reduces the service, we will give account holders reasonable notice where we can.
11.Suspension and termination
You may stop using the service at any time and ask us to delete your account by writing to gamifysaas@gmail.com.
We may suspend or terminate an account that breaches these terms — in particular the acceptable use rules above — or where we are required to by law. Where circumstances allow, we will warn you first and give you a chance to put it right. For a serious breach, or where leaving the account active would harm other users, we may act immediately.
On termination your right to use the service ends and your data is deleted on the schedule set out in the Privacy Policy.
12.Disclaimers
The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted or error-free, that activity from connected services will be captured completely or on time, or that points, streaks, and badges will be calculated without error. Do not rely on them for any decision — about pay, performance, employment, or anything else — that needs an authoritative record.
13.Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, nor for any loss of profits, revenue, data, or goodwill, arising out of your use of the service.
Our total liability arising out of or relating to these terms is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars.
Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. If your local law does not allow some of the exclusions above, they do not apply to you.
14.Indemnity
You agree to indemnify us against any claim, loss, or expense arising from your breach of these terms, your misuse of the service, or your connecting a third-party account you were not entitled to connect.
15.Changes to these terms
We may update these terms. The date at the top of this page always shows when they last changed. For a material change we will email account holders at least 30 days before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms; if you do not accept them, stop using the service and ask us to close your account.
16.Governing law
These terms are governed by the laws of [STATE / COUNTRY], without regard to its conflict of laws rules, and the courts of [STATE / COUNTRY] have exclusive jurisdiction over any dispute. If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country you live in.
